Civil Liability for Law Enforcement Officers
Professor Gregory Gilbertson (Ret.) currently works as an expert witness specializing in police practices, use of force, false arrest, and self-defense casework. To date he has assisted attorneys secure nearly $50 million dollars in damages for victims of police misconduct. Professor Gilbertson now brings the lessons he’s learned as an expert witness to your agency. His goal is to provide your officers with insightful and informative training designed to alert them to conduct which could or likely would result in civil rights or other litigation. To this end, Professor Gilbertson and his instructors provide officers with training on the following topics:
Civil Liability: Officers will learn how improper actions such as unlawful detainment, false arrests, illegal searches, excessive force, and failure to follow agency policy can expose them to civil litigation. The importance of accurate reports will also be discussed.
Use of Force: Officers will learn the evolving standards of use of force, to include levels of resistance, threat assessment, proportionality, and de-escalation tactics. Officers will also be trained to make defensible, split-second decisions that minimize their liability based upon the retaining agency’s actual use of force and vehicle pursuit policies.
False Arrest: Officers will learn the constitutional standards for investigative stops, detaining suspects, searching suspects, searching vehicles, seizing weapons, contraband, and strategies for effecting lawful arrests which preclude civil lawsuits.
Police Misconduct & Duty to Intervene: Officers will be trained to recognize and respond to misconduct by other officers. This includes the benefits of self-reporting, accountability, and ethical decision-making which maintain integrity and public trust.
Deposition & Trial Testimony: Officers will be trained on how to properly prepare for deposition examination and trial testimony. This includes the necessity of reviewing all videos, arrest reports, supplemental reports, use of force reports, and CAD reports.
Prior to beginning this 4-day course all students will receive a course syllabus and detailed learning objectives. All instructors are retired local, state, or federal officers with over 100 years of combined experience. The tuition for this course is $33,000.00. This fee allows for enrollments up to 250 students so long as adequate classroom space is provided by the sponsoring agency.
